1. Organizing company

The organization of the draw is promoted byDesertislablanca SL, with NIF B-16635559 and registered office at Av. Ignacio Wallis no. 21 4th, 07800 Ibiza, from now on and indistinctly the organizer.

2. Particular bases

The requirements to participate will be those described in the material destined for the promotion of the draw and that will be detailed later, and will include the necessary information in relation to the duration, form of participation, cost of participation, as well as the location of the general bases of participation.

The Organizer reserves the right to make the modifications or add the annexes on these bases in relation to their mechanics and prizes, which they consider pertinent, provided that they are justified, do not harm the participants, are carried out within the period of validity of the promotion and are published in the same medium as those present.

3. Acceptance of the bases

Participation in this draw supposes the full and unconditional acceptance of these general and particular bases that the organizer establishes. Recognition as a valid participant is subject to compliance with the requirements established in point number 4 of these general bases.

The organizer reserves the right to disqualify participants who do not comply with them and/or who go against these bases.

4. Participation requirements

Participation will be completely free, without it being necessary to acquire any product or the payment of a fee to compete.

Participants must be over 18 years old, reside in the European territory, and meet the participation requirements described below:

• It must be a natural person (being automatically excluded those users who are not real or suppose a false identity)
• Be a follower/follower of the Instagram account @hotelenviaalmeria
• Make as many comments as you want in the raffle publication, mentioning a person with whom you would like to share the prize. Only one person is allowed for each comment made.
• Both the participants and their companions must have a legal and valid identification document
• Do not use this promotion to: spread political or religious ideas; promote insults or slander against third parties; use violent, obscene, or offensive language; and/or publish content other than the mechanics of the promotion.
• Accept the present bases of participation in full and without reservation. These legal bases intend that the draw between the different participants is done with equal opportunities and with strict respect for the rules of good faith. For this reason, any abusive or fraudulent use of these bases will lead to the consequent disqualification of the participant. In the case of detecting irregularities in the behavior of the participants, the organizer will be forced to eliminate the participant. The organizer also reserves the right to eliminate all those participants who are false or of doubtful origin based on the profile standards on Instagram. In case of verifying irregularities after the acceptance of the prize, the organizer reserves the right to exercise all the legal actions that assist him against the offenders. In any case, participants who do not meet the participation requirements set out in these bases will be disqualified.

All AzuLineHotels employees, and people directly related to them (parents, children, siblings, cousins, couples...) are excluded from the participation.

5. Start and end dates of the draw

The start dates for participation in this draw will begin on September 1, 2022 and will be terminated on September 11, 2022. Likewise, the deadline for participation in the draw will be announced through its promotional material.

6. I use Instagram as a draw platform

Through the acceptance of these bases, the participants disassociate them from any claim they could make during the development of the promotion, and they accept that Instagram is only a platform totally independent of the promotion with the sole purpose of being used as a means of dissemination and promotion of the draw.

Instagram does not endorse or manage the promotion in any way, nor is it associated with it. The information that the participants provide, they do so to the organizer and not to Instagram. The information of the participants will only be used for the assumptions provided for in these bases.

7. Draw operation

Participation will be done through the Instagram platform, for this reason it will be essential that the participants are users of the same, as well as followers/followers of @hotelenviaalmeria.

The mechanism of participation in the draw will be as follows: @hotelenviaalmeria You will publish an image on your profile by communicating the draw, where users who want to participate must name the person in the comments available at the bottom of this promotional image.

Users will be able to participate as many times as they want, commenting and mentioning a person for each published comment. The number of comments will not influence the final result of the draw.

The winner will be chosen from among all the contestants through the use of computer applications.

8. Choice of the winner.

After the draw, the organizer will verify that the winner of the same meets all the requirements established in these bases and that they can be declared winners. To do this, the organizer will contact the winning user of the draw through a private message (DM).

They must respond by private message on Instagram within a maximum period of 48 hours from when the organizer has contacted him and must respond with the following information:

• Conformity and express acceptance of the prize or waiver equally express to it (conditioned or limited acceptances will not be valid). • Once verified that all the requirements set in the bases are met, the Organizer will also communicate by message and/or email the declaration of winner of the draw to the attractive user. The organizer will be able to publish the final winner of the draw through his Instagram page.
• It is considered as non-acceptance of the prize and, therefore, renounces it: • If at the time of making the prize effective, it is verified that the data provided by the participant is false or does not correspond to their real data. • If at any time a breach of the participation requirements contained in these bases is discovered. • If at any time it is discovered that the winner has incurred in any of the causes of disqualification contained in these Bases. • If the prize is not accepted within the indicated deadlines.
• Waiver of the prize will not give the right to compensation or compensation.

9. Prize

The prize does not include travel to the hotel.

The prize will be effective under the following conditions: 1. The prize may not be subject to change, alteration or compensation at the request of a winner; 2. The prize is non-transferable; 3. It is not redeemable for other products or for any financial compensation.

The name of the winner may be published on the different digital platforms of the organizer, such as their website or their page on Instagram, according to the data protection clause and transfer of image rights of these rules. The Draw Acceptance Mechanism will notify the winner individually once this is officially declared.

10. Contact and claims

Participants can contact the organizer through the following email:legal@azinehotels.com, where they can also be addressed for any doubt or claim that may arise due to this draw.

The participants will have a period of 15 calendar days, from the day on which the winner of the draw is known, to file a claim if they consider it pertinent.

11. Processing of personal data

Desertislablanca SLIn accordance with the provisions of current regulations on the protection of personal data, it informs that the data will be incorporated into the treatment system owned by Desertislablanca SL, with NIF B-16635559 and registered office located in Avda. Ignacio Wallis, 21, 3rd 07800, Ibiza (Illes Balears), with the aim of being able to facilitate, expedite and fulfill the commitments established between both parties, and related to the participation and celebration of the draw.

In compliance with current regulations, Desertislablanca SLIt informs that the data will be kept for the period strictly necessary to comply with the aforementioned precepts. 

This clause is informed that the data will be communicated if necessary to: Banks and Savings Banks, Public Administrations and all those entities with which communication is necessary, in order to comply with the provision of the aforementioned service. Failure to provide the data to the aforementioned entities will imply that the participation in the draw cannot be continued.

As long as it is not reported otherwise, it will be understood that the data has not been modified, both entities agree to notify any variation by giving their consent to use them for the aforementioned purposes. 

For their part, the Desertislablanca SLThey report that they will proceed to process the data in a lawful, fair, transparent, adequate, pertinent, limited, accurate and up-to-date manner. That is whyDesertislablanca SLYou agree to take all reasonable measures so that they are suppressed or rectified without delay when they are inaccurate. 

In accordance with the rights conferred by current regulations on data protection, the rights of access, rectification, limitation of treatment, deletion, portability and opposition to the processing of your personal data as well as the consent given for the treatment of the same, can be exercised, addressing your request to the postal address listed above or emailjuridico@azinehotels.com. 

In the same way, it may be directed to the competent control authority to present the claim it deems appropriate. 

• The organizer (Sends Almería) may declare the draw as null for unforeseen events that are not controllable by it, as well as interruptions in the normal operation of the Instagram platform itself or in the event that the organizer detects a malpractice that determines that there is some alteration by third parties.

 

12. Applicable law and jurisdiction.

Promotional actions are governed by Spanish law.

The organizer, and the participants in the promotion, expressly waiving any other jurisdiction, submit to that of the Ibiza courts and courts for any controversy that could arise from this draw.
